General
The user is solely responsible to provide valid and accurate information needed to complete Xigold Exchange orders. The user is solely responsible for all payments, even if the instructions provided by user are incorrect.
Users must be aware that the electronic transfer of the product into the wrong account due to a wrong account number given by the user are not reversible. We have no powers to retrieve the product placed in another users account. You simply must give us the correct account number to prevent this from happening.
Xigold Exchange orders are binding contracts between the user and Xigold Ltd. and will be honoured by the user. Payment must be good funds of the exact amount specified in the user's order, net of all fees.
If the user fails to remit good funds of the exact amount specified in the users order, net of all fees, Xigold Ltd.
at its sole discretion, may reduce the Xigold Exchange order to the amount of funds received.
If the user remits more than the amount of good funds necessary to fulfil their order, net of all fees, then Xigold Ltd. at its sole discretion, may: 
(i) adjust the users order to the exact amount of funds received,
(ii) enter a new order for the amount of the excess funds received at the exchange rate at the time of the entry of the new order.
Payment may not be counterfeit or otherwise fraudulent. The user agrees that any attempt to remit fraudulent funds will result in prosecution to the fullest extent of the law and the notification to the general public of user's actions via posting on the Xigold Exchange web site, public and private discussion boards or by any other means, at Xigold Ltd.'s discretion. 
Payments are final and not reversible except as provided in this Agreement and as displayed in our Refunds, Returns and Cancellation Policy.
Any tax consequences of Xigold Exchange orders and or transactions are the sole responsibility of the user. 
The product transfer to the product account nominated by the user in their order will occur, subject to availability, within 48 hours of the funds being fully cleared and received to the satisfaction of Xigold Exchange.
In the case of domestic bank cheques and International cheques (i.e. foreign currency cheques sent to the South Korea or any of our International banks) and money orders from any source, the funds will not be accepted and will be returned.
We reserve the right to refuse service to particular individuals or entities, at our sole discretion, with or without cause. NO correspondence will be entered into. 
We reserve the right to report any fraudulent or suspicious activity to the appropriate authorities. 
Members must supply valid identification documents to accompany their membership application when Xigold LTD request. Documents must be clear copies of a current Passport or Drivers Licence, along with a recent utility bill or bank statement. Other means of identification or documentation may be requested by Xigold Exchange at any time. Members must supply a valid landline telephone number Mobile phone or Internet phonein which Xigold Exchange staff can call to verify membership contact and order details. We reserve the right to cancel pending memberships and orders if we are unable to make contact. This is a due diligence requirement to avoid fraud and illegal activity (including Money Laundering). As we are a money service business we are required by South Korea and International financial regulations to perform these KYC (Know Your Customer) tasks.
This service is independently operated and is neither endorsed by nor affiliated with any Digital Gold or Silver provider. In the event of any questions about our service and/or your order, you should contact us directly using the Support section of the web site. Please do not contact the Digital Gold or Silver provider about an order, as they will not be able to help you with any issue relating to this service. 

All transactions into or out of or between accounts of Digital Gold or Silver operators shall be subject to the Terms & Conditions of those operators as outlined on their respective web sites. 
Xigold Ltd. will not be responsible for delays or failures in the transmission, receipt or execution of orders, remittances, payments, or information due to events or systems beyond its control. The obligations of this contract precede any government enactment. Xigold Ltd., its owners, employees, agents or affiliates will not be responsible for any loss, damage or injury resulting from any event or system beyond its control.
Xigold Ltd. will not fulfil any exchange transactions ordered by the user if the user uses, or attempts to use the Xigold Exchange service in connection with tampering, modifying or otherwise corrupting the security or functionality of the Xigold Exchange services. Additionally, the user will be subject to damages and other penalties, including criminal prosecution where available and the notification of the general public of the user's actions, at the sole discretion of Xigold Ltd.
Xigold Ltd. will not fulfil any exchange transactions ordered by the user, if ordered not to do so by an order from a court or arbitration body of acceptable jurisdiction or official body or group such as a Market Makers Association, or gold supplier such as e-gold for example, or as determined by Xigold Ltd.
The user is solely and completely responsible for the Gold or Silver account given in any order to Xigold Ltd. and the contents and disposal of contents thereof. Xigold Ltd. will not be held responsible for the use or disposal of the value or contents of any Gold or Silver account. This especially includes investment programs. We are not affiliated to, nor do we endorse investment programs. If our banner or link appears on any such program this is merely an advertisement of our services. We stress the danger involved in any such programs and suggest extreme caution before transferring any amount of Gold or Silver to them.
The Xigold Ltd. does not operate its own investment program.

Security
Xigold Ltd. (using the trading name of The Xigold Exchange) takes the security and privacy of its systems and its customers' data very seriously. We constantly review our systems and data to ensure the best possible service to our customers. Xigold Ltd. will investigate any breach of security with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

Exclusions and Limitations
The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, Xigold Ltd.
(a) excludes all representations and warranties relating to this web site and its contents, including in relation to any inaccuracies or omissions in this web site; and
(b) excludes all liability for damages arising out of or in connection with your use of this web site. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised Xigold Ltd. of the possibility of such potential loss) or any indirect, consequential and incidental damages.
